📢 HOW TO FILE A COMPLAINT for a FALSE DCF REPORT in FLORIDA

If you’ve been targeted by a false, malicious, or retaliatory DCF report, you are NOT powerless. Here’s how to take action and hold the person accountable under Florida Statutes § 39.205(9) and 39.206.

⚖️ UNDERSTAND YOUR RIGHTS

Florida law makes it a crime to knowingly file a false report to DCF.

📜 FL Statute 39.205(9):
Anyone who knowingly and willfully makes a false report, or causes another to make a false report, can be charged with a felony and held civilly liable for damages.

📜 FL Statute 39.206:
Victims of false reports have the right to pursue civil action for damages, attorney’s fees, and other relief.

🧾 STEP-BY-STEP: HOW TO FILE YOUR COMPLAINT

1. Gather Evidence

   • Save the report ID (case number), date/time of DCF contact, and any communications (texts, emails, recordings, etc.).

   • Note any pattern of harassment or retaliation that supports your claim.

2. Draft Your Complaint

   • Clearly state why the report is false or malicious.

   • Identify the reporter if known.

   • Request investigation under Statute 39.205(9) and appropriate disciplinary action.
