Florida Statute § 1012.315: Disqualification from Educator Certification and Employment

        Florida law is crystal clear:

Anyone who has been convicted of, pled guilty/nolo contendere to, or had adjudication withheld for certain offenses is disqualified from working in any position with direct contact with students.

One of the specifically listed offenses?

“Any offense listed in s. 817.034 – Organized Fraud.”

Read the statute yourself: §1012.315(1), Florida Statutes http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=1000-1099/1012/Sections/1012.315.html

        Yarnell Williams’ Criminal Charges:

        Charge 1 – §817.034(4)(a)2

        Organized Scheme to Defraud ($20,000–$50,000)

        Second-degree felony — Adjudication Withheld

        Charge 2 – §817.034(4)(a)3

Organized Scheme to Defraud (Less than $20,000)

        Third-degree felony — Adjudication Withheld

It doesn’t matter that adjudication was withheld.

Florida law still counts it as disqualifying.

Why She Can’t Work in a School:

These are felony offenses under 817.034

They are explicitly listed in the disqualification statute

No loophole exists for adjudication withheld

No exemption can be requested until at least 3 years after completing all court sanctions

Even then, financial fraud is rarely approved for exemptions

So Why Is She Still on Campus?

This is a direct failure of oversight by the school district and violates the law meant to protect Florida’s students.

        Parents and taxpayers deserve answers.

Palm Beach Prep Charter Academy We demand:

        – Immediate removal from any student-facing position

        – Full investigation into hiring practices

        – Accountability for whoever signed off on her employment

        Florida law is not optional.

Let’s stop pretending it is when it comes to our kids.
