NOTICE OF REASONS
Delray Beach, Florida 33444, VERNICKA ODENE ROLLE,
Department of Education Number 898836, having filed her application for a Florida Educator’s Certificate before the Department of Education; and The Department of Education having reviewed the application in accordance with Sections 1012.56, 1012.795 and 1012.796, Florida Statutes, has determined that VERNICKA ODENE ROLLE is not entitled to the issuance of a Florida Educator’s Certificate, accordingly;
The Department of Education files and serves upon the Applicant, VERNICKA ODENE ROLLE, its Notice of Reasons for its denial in accordance with the provisions of Section 120.60, Florida Statutes, and as grounds therefore, alleges:
1. On or about May 26, 1998, Applicant, as an employee, made one or more fraudulent refund transactions totaling $49.99 and kept the money for herself. Prior to June 3. 1998, Applicant removed several magazines valued at $31.47 from the store without paying for them. On or about May 25, 1999, Applicant was arrested and charged with Petit Theft. On or about November 23, 1999, the state attorney’s office dismissed the case following Applicant’s completion of a pre-trial intervention program.
2. On or about May 16. 1999, Applicant, as an employee of a hotel n Tallahassee, improperly credited her credit card following a stay at a Lantana location of the same hotel chain. On or about January 20, 2001, Applicant was arrested and charged with Petit Theft. On or about January 18, 2002, the state attorney’s office dismissed the charge following Applicant’s completion of a pre-trial intervention program.
3. On or about January 20. 2001. Applicant was in possession of a stolen license tag validation sticker. Applicant was charged with Attaching Tag not Assigned. Or or about February 13, 2001. the court withheld adjudication of guilt.
STATUTE VIOATIONS
COUNT 1: The Applicant is in violation of Section 1012.56(2)(e), Florida Statutes, which requires that the holder of a Florida Educator’s Certificate be of good moral character.
COUNT 2: The Applicant is in violation of Section 1012.56(10)(a), Florida Statutes, which provides that the Department of Education may deny an Applicant a certificate if the department possesses evidence satisfactory to it that the Applicant has committed an act or acts. or that a situation exists for which the Education Practices Commission would be authorized to revoke a teaching certificate.
COUNT 3: The Applicant is in violation of Section 1012.795(1)(a), Florida Statutes, in that she obtained or attempted to obtain the teaching certificate by fraudulent means.
COUNT 4: The Applicant is in violation of Section 1012.795(1)(c), Florida Statutes, in that she has been guilty of gross immorality or an act involving moral turpitude.
COUNT 5: The Applicant is in violation of Section 1012.795(1)(i), Florida Statutes. in that she has violated the Principles of Professional Conduct for the Education Profession prescribed by State Board of Education rules.
RULE VIOLATIONS
COUNT 6: The allegations of misconduct set forth herein are in violation of Rule 6B1.006(5)(a), Florida Administrative Code, in that Applicant has failed to maintain honesty in all professional dealings.
COUNT 7: The Applicant is in violation of Rule 6B.1006(5)(g). Florida Administrative Code, in that she has misrepresented one’s own professional qualifications.
“WHEREFORE, the undersigned concludes that VERNICKA ODENE ROLLE has committed an act or acts or that a situation exists for which the Education Practices Commission would be authorized to revoke an educator’s certificate. It is therefore, respectfully recommended that the Education Practices Commission affirm the Department of Education’s denial of the issuance of a teaching certificate to the Applicant based upon the reasons set forth herein, in accordance with the Explanation of Rights form which is attached to and made a part of this Notice of Reasons.”
